To the fullest extent permitted by law, any dispute arising out of or related to these Terms, the Site, or your use of the Site will be brought in the state or federal courts located in Utah, and you consent to the jurisdiction of those courts.
You waive any objection to venue or inconvenient forum in those courts.
23. Dispute Resolution
Before filing a claim, you agree to first contact us at support@mypeakmobile.com and attempt to resolve the dispute informally.
If the dispute cannot be resolved informally, either party may pursue available legal remedies in accordance with these Terms and applicable law.
Optional attorney-review clause: You may add arbitration language, but do not blindly paste in a binding arbitration/class-action waiver clause without legal review. Arbitration clauses can be enforceable but must be drafted carefully, especially for consumer-facing businesses. Utah has adopted arbitration-related provisions addressing enforceability and arbitrability.
24. Class Action Waiver
To the fullest extent permitted by law, you and Peak Mobile Management agree that any dispute will be resolved only on an individual basis and not as a class, consolidated, representative, collective, or private attorney general action.
This section does not prevent either party from participating in a class-wide settlement if legally permitted.
Have a Utah attorney review this section before launch if the business serves consumers.
25. Force Majeure
We are not responsible for delays, failures, interruptions, or inability to perform caused by events beyond our reasonable control, including but not limited to:
- Acts of God
- Weather events
- Natural disasters
- Fire, flood, or storms
- Labor shortages or disputes
- Supply chain delays
- Power outages
- Internet or hosting failures
- Cyberattacks
- Government actions
- War, terrorism, civil unrest, or emergencies
- Illness, epidemic, or pandemic
- Third-party service failures
26. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect.
